Terms & Conditions

These Terms & Conditions (“Terms”) govern access to the Khwardn website, cafe dashboards, TV leaderboards, and the Khwardn mobile app. By creating an account, visiting a cafe that uses the platform, or downloading the app you agree to these Terms.

The service

Khwardn provides digital menus, live entertainment (including trivia and football predictions), table bookings, advertisements, push notifications, and related cafe tools. Features available to a guest depend on location, cafe configuration, and whether the guest is signed in or using a guest session.

Accounts

• You must provide accurate information and keep your login details secure.
• Google, Apple, email, and guest sign-in are supported. Guest users cannot subscribe to cafe notifications or join paid events that require an account.
• You are responsible for activity under your account. Tell us if you believe it has been misused.
• We may suspend accounts that abuse games, spam notifications, or attempt to interfere with other users or cafes.

Cafe operators

Cafe owners and staff who use the cafe panel must have authority to represent that venue. Subscription pricing, player fees, branding, menus, and event content are configured by the cafe or by platform administrators. Operators are responsible for the accuracy of their menus, prizes, opening hours, and promotional claims.

Fees and payments

• Platform subscription fees for cafes and per-player event fees are set by an administrator and communicated to cafe operators directly.
• Table booking fees are charged per seat at the rate configured for the event and processed through First Iraqi Bank (FIB) where enabled.
• Failed, reversed, or incomplete payments may cancel a booking or event entry.

Events and games

Event schedules, application deadlines, and game rules are set by the cafe. Submissions after a deadline are not accepted. Leaderboard results are calculated after the event window and may be shown on cafe screens. Prizes are offered by the cafe, not by Khwardn, unless we expressly say otherwise.

Location and access

Some features, including digital menus, unlock only when your device reports a location inside the cafe’s geofence. Location is an estimate; GPS error, denied permissions, or an incomplete cafe polygon can affect access. Nearby event listings remain available outside a cafe zone.

Acceptable use

You agree not to:

• Cheat, automate, or otherwise manipulate games or leaderboards.
• Upload unlawful, infringing, or harmful content.
• Probe, disrupt, or reverse engineer the service except as allowed by law.
• Use another person’s account or a cafe panel without permission.

Intellectual property

Khwardn, the app, dashboards, and related branding are owned by us or our licensors. Cafe logos, menus, and event content remain the cafe’s property. You receive a limited, revocable licence to use the app for personal, non-commercial cafe visits, and cafe operators receive a licence to use the dashboards for their venue.

Privacy

How we handle personal data is described in our Privacy Policy. Using the service means you also accept that policy.

Availability

We aim to keep the service available but do not guarantee uninterrupted access. Live games, payments, maps, and football fixtures depend on third-party networks and APIs. We may change, suspend, or discontinue features with reasonable notice where practical.

Disclaimer and liability

The service is provided “as is”. To the fullest extent permitted by Iraqi law, Khwardn is not liable for lost profits, lost data, prize disputes between guests and cafes, or indirect damages arising from use of the platform. Our total liability for a claim relating to the service is limited to the amounts you paid us for the service in the three months before the claim.

Termination

You may delete your mobile account at any time. We may suspend or end access if these Terms are broken or if we shut down a feature. Cafe subscriptions end according to the commercial terms agreed with that cafe.

Governing law

These Terms are governed by the laws of the Republic of Iraq. Courts in Iraq have exclusive jurisdiction, unless a mandatory consumer protection rule says otherwise.

Changes

We may update these Terms. The date at the top of this page will change when we do. If you continue to use Khwardn after an update, the new Terms apply.
